 Section 140 r/w Rule 117  upheld by Gujarat High Court and Section 140 has  also  been amended providing rule making powers in respect of time limit for filing TRANS 1.As also challenge to Rule 117 of the Rules were held to be no longer res integra in view of the decision of Gujarat High Court in Willowood Chemicals Pvt. Ltd. Vs. Union of India (R/ Special Civil Application No. 4252 (21 of 22) [CW-4182/2020] of 2018) decided on 12th/19th September, 2018 . Bombay High Court has also upheld section 140 r/w 117 in case of Nelco Ltd providing for time limit for filing TRANS 1.
